Vendor Agreement 2026

All Exhibitors & Vendors are required to sign this Hold Harmless Agreement. If the agreement is not signed, exhibitor/vendor will not be able to participate in SMSA’s Rhubarb Days. By signing this agreement, the exhibitor/vendor understands the organizers of Rhubarb Days can, at any point from acceptance thru completion of the event, cancel my vendor application (participation), for any reason, and without compensation for expenses included and/or any potential lost profits.

By signing this agreement, the exhibitor/vendor waives all claims against SMSA’S Rhubarb Days, the Sumner Main Street Association and its employees and volunteers, and the City of Sumner and its employees, for any and all liability for any injury, loss of life, theft, damage or loss incurred before, during, or as a result of the SMSA’s Rhubarb Days event.

The exhibitor/vendor will indemnify and hold harmless SMSA’s Rhubarb Days, Sumner Main Street Association, and the City of Sumner from any and all claims, actions, or judgments arising from and related to the exhibitor/vendor's participation in the SMSA’s Rhubarb Days event, including the acts of the exhibitor/vendor's employees and helpers.

Exhibitors/vendors are responsible for reporting and collecting sales tax under Sales Tax Code 1174

Anyone who is selling children’s items (example: toys & items that have small objects that can be swallowed) must show Proof of Insurance for liability purposes. You MUST email a copy of your Proof of Insurance to events@sumnermainstreet.com with your application.

WCIA/City of Sumner will also be requiring that any food/beverage vendors provide a minimum of $1 million per occurrence, with a $2 million aggregate, for general liability insurance, and have both on going and completed operations coverage to protect against food borne illnesses. Additionally, we will need a copy of this policy sent to events@sumnermainstreet.com, and in it SMSA is to be named as the additional insured on the document (please use the address below for this document).

All vendors of consumable food products, or vendors sampling food products, must be licensed and permitted with the Tacoma Pierce County Health Department and have an approved permit at the booth during the market. You must also provide your own resource as required by the TPCHD (such as handwashing station). For more information, please visit tpchd.org

SMSA is working to make vendor parking available. Information will be provided to accepted vendors as the event draws closer. Parking will be limited and only available on a first-come, first-served basis and you may need to find street parking.

Each vendor is responsible for maintaining a clean booth space and work environment. Items not used in the operation of your booth need to be taken off-site; do not leave merchandise packaging and/or cardboard boxes in any area outside your space, including behind/near existing building and/or the food plaza area. All garbage needs to be taken to the appropriate receptacle. Prior to departure, each vendor must also ensure their booth space has been appropriately cleaned and is free of debris. Failure to meet this requirement will result in a clean-up assessment of $100.00. In addition, you may be denied participation for future SMSA events.

Rhubarb Days is a community festival. As an event, we do not allow the sale of items featuring nudity, foul language, inappropriate content and/or political content.

While participating in SMSA’s Rhubarb Days, we ask that you adhere to the rules and guidelines established in this agreement and conduct yourself in a manner that ensures our attendees have a positive experience. Failure to comply could result in the vendor being asked to leave the event premises. If the vendor refuses to vacate, the vendor booth/trailer will be removed at the expense of the owner; in addition, the vendor will be prohibited from future SMSA events. If a vendor departs before the event has ended, she/he may be denied acceptance into future SMSA events. No “roving” sales allowed.
